Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Berkeley Labs LLC ("B-Side," "we," "us," or "our") governing your use of the B-Side app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. Eligibility
You must be at least 13 years old and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements.
2. Your account
You're responsible for the activity under your account and for keeping your login credentials secure. Please provide accurate information and let us know promptly of any unauthorized use. You may delete your account at any time from within the app.
3. Connected music services
The Service lets you connect third-party accounts (such as Spotify, Apple Music, and Last.fm) and to open or play content in those apps. Your use of those services is governed by their terms and policies, not ours, and you must comply with them. B-Side is not affiliated with, endorsed by, or sponsored by any of them, and we're not responsible for their content, availability, or practices.
4. Subscriptions, billing, and trials
- Some features require a paid subscription. The price, billing period, and any free-trial length are shown in the app at the point of purchase.
- Purchases are processed through the Apple App Store or Google Play and are subject to their terms. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends.
- Manage or cancel your subscription anytime through your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
- If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
- Refunds are handled by the applicable app store under its policies, except where a refund is required by law.
5. Acceptable use
You agree not to:
- reverse engineer, scrape, or access the Service or its data other than as permitted;
- misuse, overload, disrupt, or interfere with the Service or its security;
- use the Service for any unlawful purpose or in violation of any connected service's terms;
- resell, redistribute, or commercially exploit the Service without our written permission.
6. Intellectual property
The Service — including its software, design, the "B-Side" name and logo, recommendation logic, and editorial selections — is owned by us or our licensors and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. Album art, artist names, and publication lists belong to their respective owners; we reference and present them, and any third-party "best-of" list is attributed to its publication and reframed as your personalized matches, not republished as our own.
7. Your feedback
If you send us suggestions or feedback, you grant us a perpetual, royalty-free license to use it to improve the Service, with no obligation to you.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that recommendations will match your taste, that the Service will be uninterrupted or error-free, or that connected third-party services will remain available.
9. Limitation of liability
To the maximum extent permitted by law, B-Side and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100. Some jurisdictions don't allow certain limitations, so parts of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless B-Side from claims arising out of your misuse of the Service or your violation of these Terms or any third-party rights.
11. Termination
We may suspend or terminate your access if you violate these Terms or to protect the Service. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.
12. Changes to the Service or these Terms
We may modify the Service or these Terms. If we make material changes, we'll provide notice through the app or by email and update the "Last updated" date above. Continued use after changes take effect means you accept them.
13. Governing law
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Washington will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction there.
